PROMOTION OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES OR DISTRICT OF COLUMBIA, AND PUERTO RICO, WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT THE TIME OF REDEMPTION. VOID WHERE PROHIBITED BY LAW OR RESTRICTED BY LAW.
ACQUISITION OF HALO INFINITE GAME (published by Microsoft), INTERNET ACCESS, AND XBOX LIVE GOLD MEMBERSHIP (paid subscription service sold separately) REQUIRED TO USE AND REDEEM THE HALO INFINITE IN-GAME CONTENT AVAILABLE THROUGH THIS PROMOTION.
Monster Energy Company (“Monster”) is offering the “Monster Energy® x Halo Infinite In-Game Content Promotion” (the “Promotion”). The Promotion is subject to these terms and conditions (the “Terms and Conditions”), and by participating, a participant (“Participant”) agrees to be bound by these Terms and Conditions and the decisions of Monster, which are final and binding in all respects. This Promotion begins at 12:01 AM, August 1, 2020, US Pacific Time and ends December 31, 2020 at 11:59 PM, US Pacific Time (the “Promotion Period”). Monster’s computer is the official timekeeping device for participation in the Promotion.

Eligibility: The Promotion is open to persons who are legal residents of, and physically located within, the fifty (50) United States, the District of Columbia, and Puerto Rico (the “Promotional Territory”), and are eighteen (18) years of age or older at the time of redemption. VOID WHERE PROHIBITED.

How to Obtain 2XP Codes: To obtain codes for 2XP in Halo Infinite multiplayer play, Participants must purchase any participating Monster Energy® products from any retailer in the Promotional Territory during the Promotional Period and take a picture of their purchase receipt; list of participating products is attached as Exhibit “A” and such products are collectively referred to hereinafter as, “Qualifying Products”). Participants must visit www.monster-halo.com (the “Website”) and create an account or log on to your existing account, complete the online form and submit an image of your full receipt(s) with Qualifying Product(s) starred by January 31, 2021 (qualifying purchases must have been made on or before December 31, 2020). Last day to create an account and to submit all receipts through the Website is January 31, 2021. 2XP Codes will be available to redeem on www.HaloWaypoint.com beginning on September 1, 2020. Limit one (1) receipt upload per account per day. Qualifying purchases can earn 100 points for each $1.00 spent (exclusive of tax) on Qualifying Products (1 cent = 1 point; i.e. $3.78 = 378 points). Once Participants have accumulated enough points from valid purchases (on one or multiple receipts), Participants can redeem points for codes for 2XP (each individually a “2XP Code”; collectively, “2XP Codes”) in the increments set forth below. Participants will have until February 28, 2021 to redeem their points for 2XP Codes; after such date, points will have no value and cannot be redeemed, and the Website will be taken down. Once you sign in with your Microsoft account (“Account”) and redeem a 2XP Code on www.HaloWaypoint.com, the 2XP content will be added to your library and available in-game when Halo Infinite releases. While supplies last.

Walmart MegaXP Program: Participants who purchase any Qualifying Products from Walmart, either in-store or through www.Walmart.com, within the Promotional Territory during the Promotional Period will receive double points for each purchase towards 2XP Codes (1 cent = 2 points; i.e., $3.78 = 756 points). Participants must take a picture of their Walmart purchase receipt. Participants must visit the Website and create an account or log on to your existing account, complete the online form and submit an image of your full receipt(s) with Qualifying Product(s) starred by January 31, 2021 (qualifying purchases must have been made on or before December 31, 2020). Last day to create an account and to submit all receipts through the Website is January 31, 2021. Limit one (1) receipt upload per account per day. Excepting that Participants will receive double points for their purchases, all terms and conditions applicable to 2XP set forth in paragraph 2 of these official rules shall apply to the Walmart MegaXP Program.

Snapchat Program: Participants who participate in the Monster Energy® x Halo Infinite Snapchat Experience during the months of September, October, and November of the Promotional Period will receive from Snapchat one (1) static coupon code for each month they participate; each month is a different static coupon code. Participants who collect all three (3) static coupon codes from Snapchat can then visit the www.MonsterHaloExperience.com, and create an account or log on to your existing account, and then enter all three (3) static coupon codes to receive a code for a Halo Infinite in-game weapon coating (a “Snapchat Code”). The Snapchat Code will disappear once you close Snapchat so either save the Snapchat Code or redeem it in the Website immediately. Limit one (1) Snapchat Code per Participant. Each static coupon code must be redeemed on www.MonsterHaloExperience.com by December 31, 2020 to receive a Snapchat Code. Snapchat Codes must be redeemed as specified below in Section 7. Once you sign in with your Account and redeem a Snapchat Code on www.HaloWaypoint.com, the weapon coating will be added to your library and available in-game when Halo Infinite releases. Grocery Program: Participants who buy any one (1) Qualifying Product within the Promotional Territory during the Promotional Period at one of the participating grocery locations listed on the attached Exhibit “B”, (and such grocery retailers are hereinafter collectively referred to as “Participating Grocers”) take a picture of their purchase receipt with the Qualifying Product starred, and text that image along with the keyword “Monster” to 47056, once validated, will receive a code for a Halo Infinite in-game weapon coating (a, “Grocery Code”). Standard text and data rates may apply. Participants will only receive one (1) Grocery Code regardless of the number of Qualifying Products purchased from the Participating Grocers during the Promotional Period. To receive a Grocery Code, Participants must text the image of their receipt prior to January 31, 2021. Grocery Codes must be redeemed as specified below in Section 7. Once you sign in with your Account and redeem a Grocery Code on www.HaloWaypoint.com, the weapon coating will be added to your library and available in-game when Halo Infinite releases. Meijer Program: Participants who buy any one (1) Qualifying Product within the Promotional Territory during the period of October 18 through 31, 2020 at one of the participating Meijer’s locations, take a picture of their purchase receipt with the Qualifying Product starred, and text that image along with the keyword “Unleash” to 47056, once validated, will receive a code for a Halo Infinite in-game weapon coating (a, “Meijer Code”). Standard text and data rates may apply. Participants will only receive one (1) Meijer Code regardless of the number of Qualifying Products purchased from participating Meijer’s locations during the period of October 18 through 31, 2020. To receive a Meijer Code, Participants must submit the image of their receipt prior to November 30, 2020. While supplies last.

Halo 5: Guardians Download: While supplies last, participants who create an account on the Website during the period of September 1, 2020 and December 31, 2020 will have the opportunity to redeem a code for a free download of Halo 5: Guardians. Internet access, an Xbox console, and Xbox Gold Live membership (paid subscription service sold separately) required for game play. Approximately 47,000 codes for downloads of Halo 5: Guardians available for redemption. Limit 1 per account, while supplies last.

How to Redeem DLC Codes: During the Promotion Period, Participants can claim their 2XP Code, Snapchat Code, and Grocery Code (individually, a “DLC Code”, and collectively, the “DLC Codes”) by visiting www.HaloWaypoint.com to redeem by logging on to their Account and entering their DLC Code as directed. After a Participant’s successful entry of a DLC Code, in accordance with these terms and conditions, a Participant will receive their DLC, which will automatically be saved with your Account. DLC Codes will not load into Halo Infinite until after 11:59 PM US Pacific Time on the day the game is launched, and may take up to forty-eight (48) hours to load.

NOTE: Halo Infinite (available separately) is required to use the DLC Codes redeemable through this Promotion and Xbox Live Gold (subscription sold separately) is required to use the DLC Codes on Xbox consoles. The DLC Codes cannot be redeemed nor exchanged for any monetary value. The DLC Codes content may be available for purchase and/or other giveaway(s) separately at any time.

DLC Code Limits: Each DLC Code may only be used once; subsequent attempts to re-submit or re-use the same DLC Code (whether by the same Participant or by different Participants) will be void. A maximum of sixty (60) hours of 2XP in the aggregate may be redeemed per Participant during the Promotion Period, regardless of the number and/or combination of 2XP Codes redeemed). DLC Codes must be redeemed at www.HaloWaypoint.com as set forth in Section 7 above. If any part of any DLC Code is counterfeited, or improperly reproduced or if the DLC Code does not come from this Promotion, or if any part is illegible, mutilated or tampered with in any way, or if it contains or reflects printing, typographical, mechanical or other errors, the DLC Code will be rejected and will be deemed void and invalid. Each Participant acknowledges and agrees that the respective decisions of Monster and Microsoft with respect to DLC Code entry are final and binding.
NO TRANSFER: DLC Codes cannot be sold, traded, bartered, assigned or transferred to or shared with a third party, auctioned through an online auction site, or otherwise or obtained through any source other than from one of the methods mentioned in these Terms and Conditions. DLC Codes are null and void and will be rejected if not obtained through authorized, legitimate channels.

DLC Code Verification: All DLC Codes are subject to verification at the respective sole discretion of Monster and Microsoft before a Participant receives the in-game content. Anti-fraud detection devices may be used for verification purposes. DLC Codes will be void if they fail to pass anti-fraud detection measures, or, if determined by Monster or Microsoft in their respective sole discretion, to be unauthorized, illegitimately obtained (i.e., through means other than those stated in these Terms and Conditions) or if they contain an unauthorized message, code or other marking not issued by Monster for use in this Promotion, or if defective or if they contain printing or other mechanical errors or are printed or produced in error or are illegible or unreadable or blank. No DLC Code redemption will be valid if such redemption is associated with any DLC Code deemed void for any reason, including without limitation, the following: (a) DLC Code is not verified or recognized as being validly issued by Monster or Microsoft in the Promotion; (b) DLC Code is determined to be previously entered and used, except as provided herein; (c) DLC Code is incorrectly or incompletely entered or submitted; or (d) DLC Code is void. Each Participant acknowledges and agrees that the respective decisions of Monster and Microsoft shall be final, binding and conclusive in all matters relating to the Promotion, including without limitation determinations regarding the validity of DLC Codes. Monster and Microsoft each shall have no obligation to the holder of any void DLC Code. Monster or Microsoft may, at their respective sole discretion and without obligation, elect to replace an illegible DLC Code with one (1) randomly selected DLC Code, if appropriate, upon request while supplies last. Monster and Microsoft each reserves the right to inspect and examine any illegible DLC Code prior to issuing a replacement. Replacements shall be issued at Monster or Microsoft’s respective sole discretion and may be denied in the event of non-compliance with these Terms and Conditions. Except as expressly stated above, Monster and Microsoft shall have no liability or obligation with respect to any void DLC Code.

Limitations of Liability: No responsibility or liability is assumed by Monster, Microsoft, Circle K Stores, Inc., Snap Inc., the Participating Grocers, and Fandango Loyalty Solutions, LLC and their parent, subsidiary, and affiliated companies (collectively, the “Promotion Entities”) for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Website hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail messaging transmissions; inaccessibility of the Website or any other website in whole or in part for any reason; traffic congestion on the Internet or Website; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Promotion, or loss, miscount, misdirection, inaccessibility or unavailability of a Xbox Live Gold used in connection with the Promotion. From time to time during the Promotion Period, the Promotional Entities’ respective webmaster may perform maintenance on the Website or other websites, which may result in a Participant’s inability to enter or redeem DLC Codes. Monster and the Promotion Entities are not responsible for any typographical or printing errors in the DLC Codes, or any inaccurate or incorrect data contained on the Website, including without limitation, any personal injury or property damage or losses of any kind which may be sustained to Participant's or any other person's computer equipment or mobile phone equipment resulting from online participation in the Promotion, or use of or download of any information from the Website. Use of the Website is at user's own risk. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

General Terms: By participating in the Promotion, Participants: (a) agree to be bound by these Terms and Conditions and by the interpretation of these Terms and Conditions by Monster and by the decisions of Monster, which are final and binding in all respects; (b) acknowledge compliance with these Terms and Conditions; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (d) agree to release and hold harmless the Promotion Entities.
The Promotion Entities are not responsible if the Promotion cannot take place, or if any DLC Code cannot be redeemed due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, or other events outside of the reasonable control of the Promotion Entities. If, for any reason, the Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Promotion Entities, which, in Monster’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Monster reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Promotion or any part of the Promotion. If the Promotion or any part of the Promotion is terminated or modified prior to the closing date of the Promotion, notice will be posted on www.monsterenergy.com if time permits. Monster reserves the right to modify and amend these Terms and Conditions from time to time during the Promotion.
The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision. In the event that any provision of these Terms and Conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Monster’s failure to enforce any term of these Terms and Conditions will not constitute a waiver of that provision. Participants agree to waive any rights to claim ambiguity of these Terms and Conditions. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy or terms of use on a website and/or the provisions of these Terms and Conditions, the Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Monster’s sole and absolute discretion.

Privacy: All information submitted by Participants and collected by Monster in connection with Participant’s participation in the Promotion will be subject to and will be treated in a manner consistent with Monster’s web site Terms of Use accessible at: http://monsterenergy.com/us/en/resources/terms/ and Monster’s Privacy Policy available at: www.monsterenergy.com/us/en/resources/privacy. By participating in the Promotion and opting-in to receive communication from Monster (“Monster Opting-In Participants”), Monster Opting-In Participants hereby agree that Monster may collect, use and disclose (as set forth in Monster’s Privacy Policy) their personal information submitted with the DLC Code redemption. Among other things, the information an opting in Participant provides may be used to send company updates and announcements about Monster Energy Company and its products.

Binding Arbitration: Except where prohibited by law, Participant agrees: (1) any dispute, controversy or claim arising out of or relating to the Promotion or any DLC Code redeemed shall be resolved individually, without resort to any form of class action; (2) any dispute, controversy or claim arising out of or relating to the Promotion or any prize awarded shall be resolved by binding arbitration conducted by JAMS in accordance with JAMS Comprehensive Arbitration Rules and Procedures (the “JAMS Rules”); (3) any arbitration shall be heard by one arbitrator to be selected in accordance with the JAMS Rules, in Orange County, California; (4) judgment upon any award rendered may be entered in any court having jurisdiction thereof; and (5) any award or judgment shall be subject to all limitations and releases set forth in these Terms and Conditions and be limited to actual out of pocket damages, and shall not, in any event, include any punitive, exemplary, consequential or incidental damages, attorneys’ fees or costs of bringing a claim, or any injunctive or other equitable relief. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

Governing Law: All federal, state and local laws and regulations apply. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participant and Monster in connection with the Promotion, shall be governed by, and construed in accordance with California law without giving effect to any choice of law or conflict of laws rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.
